FDA’s November 8, 2016 final rule updates procedures for certain citizen petitions and requests to stay agency action. Its effective date is January 9, 2017. This November 13 retrospective compares it with the proposal published January 3, 2012; the earlier document’s identifier begins with 2011, but that is not its publication year. [2016-26912][2011-33622]

The proposal addressed petitions related to pending abbreviated new drug applications and the 505(b)(2) pathway. It explained that FDA should not delay approval because of a request unless a qualifying written petition and a public-health necessity determination supported the delay. It also described the then-applicable 180-day period for final action on a petition. [2016-26912][2011-33622]

The final rule incorporates later statutory changes. Its scope includes qualifying petitions concerning section 351(k) biologics applications, and its section 505(q) response provision says FDA intends to respond within 150 days of receipt. That is petition-response language, not an application-approval deadline. The final text still contains a general 180-day provision with exceptions; readers must identify which provision applies. [2016-26912][2011-33622]

The rule therefore cannot be summarized as a universal faster clock for all petitions or all medicines. Scope, response and approval are separate questions, with the public-health exception remaining important. The proposal and final rule are complementary primary records in one FDA process, not independent assessments. They document procedural changes but do not establish that approvals accelerated or that any medicine reached patients sooner. [2016-26912][2011-33622]
