EPA's January 4, 2017 pesticide-certification rule does not create a general right for 16-year-olds to apply restricted-use pesticides. Eighteen remains the minimum age for certified commercial and private applicators and generally for noncertified applicators working under direct supervision. A limited exception applies only to certain noncertified users who are at least 16. [2016-30332]
All of the exception's conditions must be met. The supervisor must be a private applicator who is an immediate family member. The pesticide cannot be a fumigant, sodium cyanide or sodium fluoroacetate, and the application cannot be aerial. Qualification and other supervision duties remain. Age and family relationship alone are not enough to establish that an application fits the exception. [2016-30332]
The August 24, 2015 proposal shows what changed. It proposed an age-18 minimum for commercial and private applicators and for noncertified users under direct supervision, without this family carve-out in the proposed requirement. The final rule introduces the bounded exception while retaining the broader training and supervision framework. The two documents trace one EPA rulemaking, not separate confirmation of safety outcomes. [2016-30332][2015-19988]
The dates also need boundaries. The original final rule lists March 6, 2017 effectiveness, not immediate nationwide implementation. Existing certification plans remain in effect for three years; timely submitted amendments can keep them operating during review for up to two further years unless EPA authorizes an extension, with implementation specified in approval. This historical framework concerns restricted-use pesticides only and should not be generalized to all pesticide products or used as current compliance advice. [2016-30332]
