Aggregation and netting describe different operations in the IRS gambling-reporting record. The December 30, 2016 final rule allows certain reportable payments to be combined on one information return. It does not adopt the earlier proposal's special electronically tracked slot-machine treatment. This December 31 retrospective explains the preceding day's rule, rather than treating the weekend as its publication date. [2016-31575][2015-04437]
The 2015 proposal made the distinction explicit. Bingo and nontracked slots had a $1,200 gross threshold per game or play; keno used $1,500 after subtracting wagers on the same game. For bingo and keno, winnings received from all wagers within one game would be combined. That means combining winnings, not simply adding the amounts bet. [2015-04437]
Proposed tracked slots required two tests together: at least $1,200 in net session winnings and at least one play yielding $1,200 before subtracting wagers. The proposed session concerned the same game type at the same establishment within the local calendar day, with earlier termination possible. The final text expressly declined to adopt those tracked-slot rules. Reading the proposal alone would therefore misstate the final reporting mechanism. [2016-31575][2015-04437]
Final optional aggregation instead concerns qualifying same-type payments to the same payee within a reporting period, supported by records and signatures. Foreign-person, other-beneficiary and backup-withholding exceptions remain. It neither sweeps in every small win nor determines total tax liability. The proposal and final rule belong to one agency process; their value together is showing which reporting design survived, not independently proving an economic benefit. [2016-31575][2015-04437]
