EPA published its final composite-wood formaldehyde rule on December 12, 2016. The covered materials include hardwood plywood, medium-density fiberboard, commonly called MDF, and particleboard. Finished goods containing covered materials also fall within the rule's scope. Emission limits, testing, labeling and supply-chain documentation are distinct parts of that framework. Third-party certification concerns covered panels; the summary does not mean that every finished article needs a separate certificate. Limited exemptions apply, including resin-related provisions. For certain laminated products, the definition of hardwood plywood excludes qualifying construction using specified resins and compliant cores, with records needed to demonstrate eligibility. An exemption therefore cannot be read simply as an absence of all responsibilities. [2016-27987][2013-13258]
The original text sets February 10, 2017 as its effective date and December 12, 2017 as the general manufacture/import compliance milestone. It specifies December 12, 2023 for laminated products, but preserves earlier duties to use compliant platforms and follow fabricator recordkeeping and labeling requirements. These are the dates in the published 2016 document, not guidance on today's requirements. [2016-27987][2013-13258]
The June 10, 2013 proposal supplies the rationale for alignment: statutory emission limits were identical to California's, while practical regulatory alignment was an objective. That does not make the entire federal system identical to California's. The proposal and final rule are stages of one EPA proceeding. They establish the historical design and intended exposure reduction, not measured health improvements or a finding that every supplier was ready. [2016-27987][2013-13258]
