The Consumer Financial Protection Bureau published its final prepaid-account rule on November 22, 2016. Publication did not make its new framework immediately effective. The dated text specified October 1, 2017, as the general effective date and October 1, 2018, for the addition of section 1005.19(b). Those are the dates in this historical instrument, not a statement of current law. [2016-24503][2014-27286]

The framework covered several different tasks: disclosures, limited liability, error resolution, account information and posting account agreements. It also addressed certain overdraft-credit features under Regulation Z. Calling the instrument a prepaid-card rule is convenient, but its defined account scope and exceptions matter more than a product’s everyday label. Gift cards, for example, were among the excluded categories. [2016-24503][2014-27286]

Reading the December 23, 2014 proposal alongside the final text reveals a material change. The proposal withheld specified liability and error-resolution protections from unregistered accounts. The 2016 final applied those protections regardless of verification, but did not require provisional credit for unverified accounts. Once verification occurred, provisional-credit requirements applied within their prescribed timeframe, including for errors occurring before verification. [2016-24503][2014-27286]

This separates three questions that can otherwise become confused: when a rule was published, when a provision was scheduled to operate, and what the provision actually required. The proposal supplies evidence of the earlier design, not authority to replace the final rule’s language. Both documents belong to one CFPB rulemaking; they cannot independently demonstrate successful implementation or establish that users experienced fewer losses. [2016-24503][2014-27286]
