HUD published its Small Area Fair Market Rent final rule on November 16, 2016. Its effective date is January 17, 2017. The rule changes the rent benchmarks used to administer Housing Choice Vouchers in designated metropolitan areas. It does not announce a universal change in private rents or require every housing assistance program nationwide to adopt neighborhood-level figures. [2016-27114][2016-13939]
Small Area FMRs use ZIP codes within a metropolitan area. The June 16 proposal explains the mechanism: rents can differ enough across neighborhoods that a metropolitan benchmark may poorly match local conditions. HUD proposed using smaller areas to help voucher households reach higher-opportunity, lower-poverty neighborhoods. This explains the intended operation, not a demonstrated result of the November rule. [2016-27114][2016-13939]
The final framework requires affected public housing agencies in designated metropolitan areas to use the approach for their tenant-based voucher programs. Agencies outside designated areas may seek HUD approval to opt in. Other programs using FMRs continue with area-wide figures. Project-based vouchers are exempt from mandatory application, although agencies using Small Area FMRs for tenant-based vouchers may adopt them for projects under specified conditions, including owner agreement for current projects. [2016-27114][2016-13939]
These distinctions separate the policy’s geography, program coverage and timing. A rule’s effective date should not be turned into a claim that every household’s subsidy changes that day. The proposal and final rule are complementary records from the same HUD proceeding, not independent corroboration. They document a new administrative framework and its rationale, without proving that its anticipated mobility benefits have been achieved. [2016-27114][2016-13939]
