The Transportation Department’s November 3, 2016 final passenger-protection rule adopts four main changes: a larger reporting-carrier pool, additional code-share performance reporting, stronger online code-share disclosure and a prohibition on undisclosed carrier-identity bias in covered electronic displays. The stated effective date is December 5, 2016. That date is not the compliance date for every data-reporting provision. [2016-26178]

The May 2014 proposal had a wider agenda. It proposed disclosure of basic ancillary fees across sales channels, including information that would help travelers compare costs beyond the fare. It also considered customer-service commitments for large ticket agents and limits on post-purchase increases for certain ancillary services. These subjects explain the proposal’s broad title; they do not establish what the narrower final rule enacted. [2016-26178][2014-11993]

In November, DOT expressly reserved ancillary-fee disclosure for a supplemental proposal and other topics for another planned final rule. Meanwhile, newly covered carriers were to submit January 2018 on-time and mishandled-baggage reports by February 15, 2018, and first-quarter oversales reports by April 30, 2018. Additional reporting by marketing carriers for covered fee-for-service code-share operations likewise begins with transportation on or after January 1, 2018. [2016-26178]

The clean reading is therefore to separate enacted requirements, future compliance work and subjects still awaiting action. A plan to issue another rule is not the rule itself. Nor do new reporting requirements establish better airline performance. Both sources come from the same DOT rulemaking chain, providing development history rather than independent confirmation of benefits. This retrospective account stops at the published November framework and its stated schedule. [2016-26178][2014-11993]
