HHS published final regulations for Independent Living Services and Centers for Independent Living on October 27, 2016. The rule implemented the Rehabilitation Act as amended by the Workforce Innovation and Opportunity Act, including administration within the Administration for Community Living. Its publication did not mean every administrative step occurred that day: the stated effective date was November 28, 2016. [2016-25918]

The preceding proposal, published November 16, 2015, explained why the regulations were being rewritten. The programs had been transferred from the Department of Education to HHS under the 2014 law. The proposal sought to consolidate independent-living regulations into a single part, align them with the statute and HHS policies, and provide guidance to grantees. Its comment deadline was January 15, 2016, not a new invitation in October. [2015-28888]

The final text also supplied operational definitions. Under section 1329.4, a Center for Independent Living is a consumer-controlled, community-based, cross-disability, nonresidential private nonprofit agency. Its minimum service array includes independent-living core services. Those terms distinguish the program from a general residential-care announcement and explain why administrative location alone does not tell a reader what a center does. [2016-25918]

The proposal is useful historical evidence, but the final text is the reference for what these regulations said. Neither document announces a universal personal benefit or proves local services expanded. They are stages of the same HHS policy process, not independent corroboration of results.
