The CFPB’s October 19, 2016 publications have two distinct functions. The main final rule changes mortgage-servicing requirements in Regulations X and Z. A companion interpretation explains how specified compliant communications interact with the Fair Debt Collection Practices Act, or FDCPA. This October 22 weekend account looks back at those prior-week publications; it does not report a new Saturday rule. [2016-18901][2016-18902]
The interpretation covers three situations. Part II.A concerns compliant mortgage communications with confirmed successors in interest under section 805(b). Part II.B concerns the required modified written early-intervention notice after a borrower invokes section 805(c)’s cease-communication right. Part II.C concerns responses to borrower-initiated loss-mitigation communications after that right has been invoked. Each situation has its own boundaries. [2016-18901][2016-18902]
Those boundaries matter more than the shorthand “safe harbor.” The notice protection does not immunize other unlawful content. The borrower-initiated discussion must concern potentially available loss-mitigation options, not serve as a pretext for unrelated payment demands. The servicing rule supplies the underlying duties; the interpretation resolves specified interactions with the FDCPA rather than excusing compliance with that law generally. [2016-18901][2016-18902]
Most main-rule provisions take effect October 19, 2017; listed exceptions, including successors and bankruptcy periodic statements, take effect April 19, 2018. The companion generally starts October 19, 2017, but Part II.A starts April 19, 2018. These complementary CFPB documents belong to one policy process, not independent corroboration. They establish prospective rules and interpretations, not evidence that every mortgage borrower will receive relief. [2016-18901][2016-18902]
