Two SEC documents published in the Federal Register on October 13, 2016 require different entries on an implementation calendar. Standards for Covered Clearing Agencies is a final rule. Definition of Covered Clearing Agency is a proposal. October 13 identifies their publication in that issue, not a claim that the SEC adopted both measures that day. The final rule establishes enhanced standards for operation and governance within its defined coverage. It gives December 12, 2016 as the effective date and April 11, 2017 as the compliance date. Those are distinct milestones. Treating the earlier date as the compliance deadline would erase a distinction the SEC expressly makes in the document. [clearing-standards]
The proposal asks a different question: whether the definition should encompass registered agencies providing central counterparty, central securities depository or securities settlement system services. It also proposes expanding the scope of sensitivity-analysis requirements. Its December 12, 2016 date is a deadline for comments, not an effective date for that proposed expansion. The practical distinction is between implementing a final requirement for agencies within its scope and evaluating a possible change to that scope. A shared date does not merge those tasks. Both records come from the SEC and provide complementary procedural evidence, not independent confirmation of successful implementation. As of this coverage date, the documents establish a final-rule timetable and an open proposal; they do not show that the proposed wider coverage has become law or that compliance has already been achieved.
